The article examines four models of data governance emerging in the current platform society. While major attention is currently given to the dominant model of corporate platforms collecting and economically exploiting massive amounts of personal data, other actors, such as small businesses, public bodies and civic society, take also part in data governance. The article sheds light on four models emerging from the practices of these actors: data sharing pools, data cooperatives, public data trusts and personal data sovereignty. We propose (...) a social science-informed conceptualisation of data governance. Drawing from the notion of data infrastructure we identify the models as a function of the stakeholders’ roles, their interrelationships, articulations of value, and governance principles. Addressing the politics of data, we considered the actors’ competitive struggles for governing data. This conceptualisation brings to the forefront the power relations and multifaceted economic and social interactions within data governance models emerging in an environment mainly dominated by corporate actors. These models highlight that civic society and public bodies are key actors for democratising data governance and redistributing value produced through data. Through the discussion of the models, their underpinning principles and limitations, the article wishes to inform future investigations of socio-technical imaginaries for the governance of data, particularly now that the policy debate around data governance is very active in Europe. Internet of Things, Internet of Everything and Internet of People are concepts suggesting that objects, devices, and people will be increasingly interconnected through digital infrastructure that will generate a growing gathering of data. Parallel to this development is the celebration of the smart city and sharing city as urban policy visions that by relying heavily on new technologies bear the promise of efficient and thriving cities. Law and policy scholarship have either focused on questions related to privacy, discrimination, security, or (...) issues related to the production and use of big data, digital public services. Little or no attention has been paid to the disruptive impact of technological development on urban governance and city inhabitants’ rights of equal access, participation, management and even ownership, in order to understand whether and how technology can also enhance the protection of human rights and social justice in the city. This Article proposes complementing the technological and digital infrastructure with a legal and governance infrastructure, the Internet of Humans, by construing and injecting in the policy framework of the city the principle of Tech Justice. Building on a literature review and from an analysis of selected case studies, this Article stresses the dichotomy existing between the market-based and the society-based applications of technology, the first likely to increase the digital divide and the challenges to human rights in the city, the latter bearing the promise to promote equal access to technology in the city. The main argument advanced by this Article is that the principle of Tech Justice if embedded as an empirical dimension of smart city and sharing city policies can steer their developments in the direction of a more just and democratic city. Citizen-gathered evidence (CGE) gathered by individuals organized in collectives have the potential to demonstrate environmental and social wrongdoings in court. We identify (collective) agency and resistance in how individuals and communities that have been exposed to socio-environmental stressors turn to gather CGE. We explore the modes through which people gather scientific data, produce CGE, alert authorities to environmental harm, and the methods by which data can be shared with communities, beginning with the case studies of civic environmental monitoring addressing coal (...) ash pollution in North Carolina. We analyze the case studies through a theoretical lens built on (1) the theory of civic monitoring “as resistance;” (2) the argument that CGE can embody “collective intelligence;” and (3) the concept of “crowd science” through a decentralized yet coordinated network. In the first part of the article, we introduce the case studies. Then, we illustrate our theoretical frame as applied to the analysis of the cases. We discuss the cases and in particular the CGE at issue through the prism of the frame. We demonstrate how CGE can be valuable not only for civil society and civic organizations, but also for competent authorities. In our conclusion, we identify critical junctures of our case studies, such as that of “knowledge crowdsourcing” to demand justice that triggers the government to take action and the existence of a “coordinated” yet decentralized crowd to capture the full extension of the problem. In the present paper, we will attempt to gain hints regarding the nature of tactile awareness in humans. At first, we will review some recent literature showing that an actual tactile experience can emerge in absence of any tactile stimulus (e.g., tactile hallucinations, tactile illusions). According to the current model of tactile awareness, we will subsequently argue that such (false) tactile perceptions are subserved by the same anatomo-functional mechanisms known to underpin actual perception. On these bases, we will discuss the (...) hypothesis that tactile awareness is strongly linked to expected rather than actual stimuli. Indeed, this hypothesis is in line with the notion that the human brain has a strong predictive, rather than reactive, nature. (shrink)

It is the only object from which we constantly receive a flow of information through sight and touch; and it is the only object we can experience from the inside, through our proprioceptive, vestibular, and visceral senses. Yet there have been very few books that have attempted to consolidate our understanding of the body as it figures in our experience and self-awareness. This paper traces the intellectual trajectories of the first stand-alone theories of action, understood as both axiologically neutral and quasi-scientific from a methodological point of view. I argue that the rise of action theory of this kind corresponds to a particular moment of dissatisfaction within Western thought, and as such, it tells us far more about the history of philosophy than the subject itself. I conclude by explaining why subsequent failures to provide an acceptable theory of action are not accidental. (...) On the contrary, such failures owe themselves probably to the fact that formulating a theory of action is neither propitious nor useful. Thus, the most valuable lesson we can learn from philosophical desires for a theory of action is that we should take co-action as the starting point in our normative investigations, rather than positing action simpliciter as a problem to solve. That is, we should move away from propounding a theory of action, and instead focus on a paradigm shift, whereby we move away from a representational, towards a co-actional, model of action. Si la praxéologie mérite aujourd’hui notre attention, c’est parce qu’elle permet de remonter aux origines des « théories de l’action », des sociologies de l’action ou des philosophies de l’action qui ont marqué le xxe siècle. Que veut dire, au fond, étudier l’action, en proposer ensuite une théorie, à visée soit descriptive soit normative? Dans ce qui suit, on va étudier la question en compagnie de Tadeusz Kotarbiński (1886-1981), philosophe analytique, et de Harold Garfinkel (1917-2011), sociologue hétérodoxe. Ce texte défend (...) l’idée selon laquelle parmi les conséquences les plus marquantes du travail de Garfinkel se trouve la démystification de la « théorie de l’action », et que certaines intuitions similaires sont déjà très présentes chez Kotarbiński (dont les travaux sur l’action constituent, selon Garfinkel, un « échec extrêmement important »). La praxéologie chez les deux auteurs n’est pas une discipline, mais une façon de voir la pratique étudiée comme un tout, à l’instar des recherches menées par les théoriciens de la Gestalt. La dimension athéorique de l’étude de l’action humaine proposée ici permet d’espérer qu’un jour, les phénomènes qui nous entourent vont pouvoir être étudiés pour ce qu’ils sont, et non pas pour ce qu’une théorie élégante permet d’en dire. This paper argues that the function of moral education in the biomedical context should be exactly the same as in a general, philosophical framework: it should not provide ready-to-use kits of moral principles; rather, it must show the history, epistemology and conceptual structure of moral theories that would enable those who have to make decisions to be as informed and as responsible as possible. If this complexity cannot be attained, an incomplete product—i.e. bioethics or bioethical principles—should not be seen as (...) a viable substitute. This theoretical position is subsequently illustrated by a case study involving research ethics committees. It is argued that within these committees, that are carefully formed multidisciplinary bodies, what makes competent decision-making possible is not a bioethical theory, nor even a sound philosophical ethics, but the dynamics of the discussion of a number of experts coming from different disciplines. This multidisciplinary expertise is necessary and sufficient to undertake the challenges of complex decisions in the biomedical context. (shrink)

Background: Although attention to healthcare ethics in rural areas has increased, specific focus on rural palliative care is still largely under-studied and under-theorized. The purpose of this study was to gain a deeper understanding of the values informing good palliative care from rural individuals' perspectives. Methods: We conducted a qualitative ethnographic study in four rural communities in Western Canada. Each community had a population of 10, 000 or less and was located at least a three hour travelling distance by car (...) from a specialist palliative care treatment centre. Data were collected over a 2-year period and included 95 interviews, 51 days of field work and 74 hours of direct participant observation where the researchers accompanied rural healthcare providers. Data were analyzed inductively to identify the most prevalent thematic values, and then coded using NVivo. Results: This study illuminated the core values of knowing and being known, being present and available, and community and mutuality that provide the foundation for ethically good rural palliative care. These values were congruent across the study communities and across the stakeholders involved in rural palliative care. Although these were highly prized values, each came with a corresponding ethical tension. Being known often resulted in a loss of privacy. Being available and present created a high degree of expectation and potential caregiver strain. The values of community and mutuality created entitlement issues, presenting daunting challenges for coordinated change. Conclusions: The values identified in this study offer the opportunity to better understand common ethical tensions that arise in rural healthcare and key differences between rural and urban palliative care. In particular, these values shed light on problematic health system and health policy changes. When initiatives violate deeply held values and hard won rural capacity to address the needs of their dying members is undermined, there are long lasting negative consequences. The social fabric of rural life is frayed. These findings offer one way to re-conceptualize healthcare decision making through consideration of critical values to support ethically good palliative care in rural settings. (shrink)

The article aims at challenging the very idea of bioethics. Starting with a thought experiment which puts into perspective relations between law and ethics, a reflexion on founding moments of bioethics as a distinctive discipline will be proposed in order to contest some of its assumptions. Less traditional ways of seeing the field will be subsequently analyzed, yet the conclusion of this exploration will remain critical: we should rather think of an alternative way of seeing moral expertise in the biomedical (...) sphere, founded on plural knowledge of diverse agents who leave their moral presuppositions aside as much as this is possible. The article reviews the book Orthodox Readings of Aquinas, by Marcus Plested.

The patterns of physical growth (stature, BMI, subscapular and arm fat-fold thickness, upper and lower extremity length, chest circumference, arm, and hip breadth, and age at menarche) were studied in 857 of Maya and Mestizo girls and 1314 of Creole girls aged 6-18 years. Data were collected between 1998-2001 in primary, secondary, and high schools of Merida, Capital City of the Yucatan State, Mexico. The ethnicity of girls was defined using their two surnames (from the father and mother side). The (...) results show that Creoles are taller, have more abundant fat tissue, and greater BMI, especially at the age of 11 years, which means that they are better prepared to start pubertal spurt. Maya girls have relatively longer upper extremities to lower ones, greater biacromial breadth, and chest circumference to stature than Creoles, which shows their more stocky body build. The adolescent (pubertal) spurt in height starts earlier in Creoles (9-10 years) and its rate is greater (max. = 7.48 cm/ year) than in Maya and Mestizos girls (10-11 years; max. = 6.25 cm/year). In Mayas and Mestizos, there is only a slight difference between the rate of changes before and during the pubertal spurt. There are no significant differences in age at menarche between girls from both ethnic groups (11.96 in Mayas and Mestizos and 12.04 in Creoles), but there are statistically significant differences between age at menarche of studied girls and their mothers (12.4 for both groups) in each ethnic group. There is evidence that the onset of pubertal spurt in height and its rate may depend on ethnicity. Creoles may lead to a more “westernized” style of life than the Maya and Mestizos girls. (shrink)

The Brentanian idea that every state of consciousness involves a consciousness or awareness of itself (Brentano 1874), which has been a central tenet of the phenomenological school, is a current topic in contemporary philosophical debates about consciousness and subjectivity, both in the continental and the analytic tradition. Typically, the self-awareness that accompanies every state of consciousness is char­acterized as pre-reflective. Most theorists of pre-reflective self-awareness seem to converge on a negative characterization: pre-reflective self-awareness is not a kind of reflective awareness. (...) Whereas reflective self-awareness is attentive and descriptive, pre-reflective self-awareness is non-attentive and non-descriptive.This paper aims to show that the reflective/pre-reflective dichotomy overlooks a finer-grained distinction. The first part is devoted to arguing that the typical use of the adjective ‘pre-reflective’ conflates two properties (non-attentiveness and non-descriptiveness), which are in fact separable. Accordingly, not only can there be non-descriptive and non-attentive self-consciousness (i.e. pre-reflective self-awareness), but also non-descriptive but attentive self-consciousness. I call the latter primitive introspection. The second part of the paper is devoted to arguing that, whereas both pre-reflective self-awareness and primitive introspection enable the subject to apprehend the phenomenology of their experience, the kind of apprehension each allows for is different. By analyzing the notion of apprehension in terms of information acquisition and personal-level availability of information, it is proposed that, although both pre-reflective self-awareness and primitive introspection allow for acquisition of the maximal amount of information about the experience, only primitive introspection makes all such information personal-level available. Burks to build a formal system of logic of causal propositions along with considering their later use in the system built in 1963. In the second part of the article the possibility of conducting an axiomatic proof of the theorem on adding a superfluous condition is analyzed. The consequences are also shown of substituting a negation of the same prepositional variable for the (...) propositional variable and conditions are analyzed of substitution for propositional variables and possibilities of avoiding those difficulties. In this dissertation, I develop a post-reflexive philosophical account of self-knowing subjectivity. I argue that ambiguity, not clarity, is the hallmark of intersubjective being and knowing, and that ambiguous being is particularly evident precisely where subjectivity occupies a central place: in theory. To illustrate this claim, I turn to the ubiquitous and indispensable technology of the glassy mirror, a material object and discursive trope which I use to enliven the Beauvoirean concept of situation: a lived ambiguity of being both subject (...) and object, both universal and particular, both for-self and for-others. Far from eschewing the historical importance of precision and determinacy in Western views of knowing well, my appeal to mirrors in this project allows me to read such values as sedimented in knowers’ ways of making sense of the world – of themselves and their objects of knowledge, as these are expressed through theoretical engagements. Online educational technologies offer opportunities for providing individualized feedback and detailed profiles of students' skills. Yet many technologies for mathematics education assess students based only on the correctness of either their final answers or responses to individual steps. In contrast, examining the choices students make for how to solve the equation and the ways in which they might answer incorrectly offers the opportunity to obtain a more nuanced perspective of their algebra skills. To automatically make sense of step‐by‐step solutions, we (...) propose a Bayesian inverse planning model for equation solving that computes an assessment of a learner's skills based on her pattern of errors in individual steps and her choices about what sequence of problem‐solving steps to take. Bayesian inverse planning builds on existing machine learning tools to create a generative model relating (mis)‐understandings to equation solving choices. Two behavioral experiments demonstrate that the model can interpret people's equation solving and that its assessments are consistent with those of experienced teachers. A third experiment uses this model to tailor guidance for learners based on individual differences in misunderstandings, closing the loop between assessing understanding, and using that assessment within an educational technology. Finally, because the bottleneck in applying inverse planning to a new domain is in creating the model of possible student misunderstandings, we show how to combine inverse planning with an existing production rule model to make inferences about student misunderstandings of fraction arithmetic. The article contains the results of the analysis of concepts connected with semantic functions of names. The conception of Jacek Jadacki, exposed in his "Spór o granice jezyka" ("Controversy on the limits of language"), is the point of departure of this analysis. The following theses are formulated and argued for. (1) There are two basic semantic functions of names: the referential and the descriptive one. The first function consists in indicating some objects; the second one consists in ascribing properties to (...) some objects. (2) The concepts of indicating and ascribing are primitive ones. (3) The referential function of denotation and the descriptive function of connotation are mutually independent. The term "connotation" can be defined without using the term "denotation" and vice versa . (4) Names perform not only the function of designating, i.e. referring to particular objects, but also the function of denominating, i.e. referring to universal ( resp. postulated) objects. (5) The connotation of a given name is genetically or conventionally connected with the pragmatic function of ascribing properties to respective objects. (6) In sciences, such connotations of names are sought after, which are, at the same time, essences of designates of these names. (shrink)
